Retiree Voluntary Legal Service Plan Coverage:

Once enrolled in the plan, coverage applies to:

  • The PEF retiree and their spouse or domestic partner.
  • Unmarried dependent children under the age of 19 (including stepchildren & legally adopted children).
  • Children under the age of 25, if wholly dependent upon the PEF retiree for support and enrolled as a full-time student in an educational institution.
  • Parents of the PEF retiree, if they are wholly dependent upon the PEF retiree for their own support and maintenance.

Did you know that if you pass away without a Will, the State decides many important decisions such as who raises your children and how your assets get divided and distributed? This plan includes the creation of a FREE Simple Will or the updating of an existing one (updates free every year) utilizing the help of an experienced attorney.


The covered individual is entitled to two (2), one-hour, free, initial office consultations per calendar year with the National Legal Office or Participating Referral Attorney. The consultation cannot be used to reduce the “Plan Maximum Fees” or for the preparation of a Will or for estate planning purposes. The two (2), one-hour, free consultations cannot be combined.

Feldman, Kramer & Monaco, P.C. is highly networked nationwide. Should you have a problem that cannot be resolved on the telephone or by correspondence, you will be referred to a Legal Services Plan licensed attorney in your area at the rate of $225 per hour or a 40% reduction from their hourly rate, whichever is lower.

Active, dues-paying PEF Retirees have two payment options for enrollment in the Legal Service Plan.

Option #1: Pension Deduction for $36.00/yr — Deduct the annual legal service rate from your New York State Pension and receive the plan for $36 per year (pension deduction is monthly). Enrollment is continuous.

To enroll:

  1. Download the Pension Deduction form below.
  2. Complete the Retiree Voluntary Legal Service enrollment form and return the enrollment form, along with your pension deduction form to:

  3. If you plan to order additional riders (Business Protection Rider and/or the Elder Law Rider), select the riders on your enrollment form and enclose a check or money order (payable to PEF Membership Benefits Program) for the amount of the riders. Option #2: Direct Pay using a one-time fee for $36.00/yr — You can pay for the Retiree Voluntary Legal Service Plan in one payment with your Visa or MasterCard, the annual fee is $36.

Exclusions: Matters related to the pursuit of business are excluded unless the optional Business Protection Rider is purchased (refer to Optional Business Protection Rider section on website). Matters relating to Federal Court, patent, copyright, trademark, tax matters, immigration and pensions are excluded. Fines, court costs, penalties, filing fees, disbursements and other expenses relating to legal services and litigation are not covered under this Plan. Nor are certain exceptions, such as employer/employee related situations, legal matters between people or groups associated with the Legal Service Plan, appeals, and matters arising outside the continental United States, class actions and repetitious matters where circumstances have not substantially changed.
